In principle, your personal data is collected directly from you during the recruitment process, in particular from the application documents, the job interview and the personnel questionnaire. We may also receive information from personnel consultants and recruiters through employment agencies. In addition, personal data that we have legitimately obtained from publicly accessible sources (e.g. professional networks) may be processed.

For what purposes and on what legal basis will the data be processed?

We process your personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

In the first instance, the purpose of data processing is to establish the basis for an employment relationship. The primary legal basis for this is Art. 88 (1) of the GDPR in conjunction with Section 26 (1) of the BDSG.

Your data will only be processed for the purpose of filling the specific position for which you have applied. In addition, the processing of health data may be necessary for the assessment of your ability to work in accordance with Art. 9 (2) (h) in conjunction with Section 22 (1) (b) BDSG.

If you wish to be included in our applicant pool should your application be unsuccessful, we will require a declaration of consent from you. If your application should be considered for other vacancies in the company/Group, we will require a declaration of consent in this regard from you.

In addition, the European anti-terrorist regulations 2580/2001 and 881/2002 require us to compare your data against the so-called "EU terror lists" to ensure that no funds or other economic resources are made available for terrorist purposes.

For how long is your data stored?

If you are hired, we will place your application documents in your personnel file. After the employment relationship is terminated, the personal data that we are legally obliged to retain will continue to be stored. This arises from legal burden of proof and retention obligations, which are governed, inter alia, by the German Commercial Code and the German Tax Code. Accordingly, the retention periods are up to ten years. In addition, personal data may be stored for the period during which claims can be asserted against us (statutory limitation period of three or up to thirty years).

Should your application be unsuccessful, your application documents will be deleted no later than six months after completion of the application procedure, unless you have given us your consent for longer retention (applicant pool).

Who receives your data?

Within our company, only those persons and bodies (e.g. departments, works council, representatives for severely disabled persons) who are involved in the decision on your employment will receive your personal data.

As a data subject, what rights can you assert?
